Terms and Conditions for the Sale of Homemade Soap

1. Introduction

Welcome to Elderberry Hollow Homestead, LLC (DBA “Elderberry Hollow”) (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern all sales of our homemade soap products (“Products”) to you (“Customer,” “you”). By placing an order, you agree to be bound by these Terms.

2. Product Information & Safety

  1. Our Products are handcrafted in small batches. Variations in color, scent, and appearance are normal.
  2. Ingredients are listed on each product page and label. If you are allergic to any listed ingredient, do not use the Product.
  3. Our Products are for external use only. Avoid contact with eyes; if soap gets into your eyes, rinse thoroughly with water. Discontinue use if irritation occurs and consult a physician if necessary.
  4. Shelf Life & Storage. Results may vary because individual skin types differ, and natural color or scent may fade over time. For best quality, use within one (1) year of the purchase date and store in a cool, dry place between uses.
  5. No Medical or Cosmetic Claims. We make no guarantees regarding the therapeutic, medicinal, or cosmetic effectiveness of our Products. Statements about our Products have not been evaluated by the U.S. Food and Drug Administration (FDA).

3. Assumption of Risk

By purchasing and using our Products, you acknowledge and accept full responsibility for any outcomes, whether positive or negative, that may result from their use. You agree to use the Products solely at your own risk and agree that we shall not be liable for any injury, loss, or damage arising from such use.

3. Ordering Process

  1. Orders can be placed via our website, email, or authorized marketplace listings.
  2. All orders are subject to availability and acceptance. We reserve the right to refuse any order.
  3. Once your order is placed, you will receive an order confirmation email. A separate shipping confirmation email is sent when your order dispatches.

4. Pricing & Payment

  1. All prices are listed in U.S. dollars and are subject to change without notice.
  2. The price charged will be the price at the time the order is placed, including any applicable taxes and shipping fees.
  3. We accept the payment methods displayed at checkout. Full payment is required before shipment.

5. Shipping & Delivery

  1. We currently ship within the United States. For international orders, contact us prior to purchasing.
  2. Shipping costs and estimated delivery times are displayed at checkout. Delivery times are estimates only and not guaranteed.
  3. Risk of loss passes to you upon our delivery to the carrier. We are not liable for delays or loss caused by the carrier.

6. Returns & Refunds

  1. Due to the personal nature of our Products, all sales are generally final. However, if your order arrives damaged or incorrect, contact us within 7 days of delivery.
  2. To qualify for a refund or replacement, provide your order number and clear photos of the issue.
  3. Approved refunds will be credited to the original payment method within 7–10 business days.

7. Disclaimer of Warranties

Our Products are provided “as is” without any express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non‑infringement, to the maximum extent permitted by law. Because skin types and conditions vary, results may vary and no guarantee of specific outcomes is offered.

8. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the sale of Products shall not exceed the amount you paid for the applicable order. We shall not be liable for any indirect, special, incidental, or consequential damages.

9. Intellectual Property

All content on our website and packaging, including logos, text, graphics, and images, is our property or licensed to us and protected by intellectual property laws. You may not use such content without our prior written consent.

10. Privacy

We respect your privacy. Your personal information collected during checkout is used solely to process and fulfill your order, in accordance with our Privacy Policy.

11. Dispute Resolution

If a dispute arises out of or relates to these Terms or your purchase of our Products, you agree to first attempt to resolve the dispute informally through good-faith negotiation within 30 days. If the dispute cannot be resolved through negotiation, you agree to participate in mediation administered by a mutually agreed-upon mediator before pursuing any other remedies.

If mediation does not resolve the dispute, then, except for matters that may be taken to small claims court, you agree that the dispute will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Oldham County, Kentucky. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.

By agreeing to arbitration, you waive your right to a jury trial and to participate in any class action or representative proceeding.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Kentucky, without regard to its conflict of laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Oldham County, Kentucky.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will be revised accordingly. Continued purchases after changes constitute acceptance of the updated Terms.
